Terms of Service

The rules for using astrahomebuyer.com and what our communications do — and don't — commit either of us to. We've tried to write this in plain English. If anything is unclear, email [email protected] and we'll explain.

  • This website is informational — nothing on it is a binding cash offer until we send you one in writing and you sign a separate purchase agreement.
  • We are a real estate investor buying for our own portfolio, not a licensed real estate broker, agent, attorney, or tax advisor.
  • Any "offers" or estimates we discuss before a written purchase agreement are conversation, not commitment — and we promise the same goes for you.
  • Every Astra purchase agreement includes a built-in 5-day cancellation period, even when California law doesn't require one.
  • When you provide property details, you confirm you have the right to do so (you own the property, or you're an authorized agent or executor).
  • We try to keep website information accurate, but property values and market data can change quickly — verify anything important with a licensed professional.
  • Disputes are resolved under California law, and we don't take legal action against sellers who change their minds during the cancellation window.

1. Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of astrahomebuyer.com (the "Site") and any communications you have with Astra Home Buyer LLC ("Astra," "we," "us," or "our") before signing a written purchase agreement.

By using the Site, contacting us, or submitting any information through our forms, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site or contact us.

You must be at least 18 years old to use this Site and to consider selling a property to us. If you are using the Site on behalf of an entity (such as an estate, trust, or LLC), you confirm that you have the authority to bind that entity to these Terms.

2. About Astra Home Buyer

Astra Home Buyer LLC is a California-registered limited liability company. We purchase residential properties across California with our own capital. We do not represent buyers or sellers as agents. We do not broker third-party transactions. We are not a financial institution.

You can verify our registration with the California Secretary of State.

3. Using our website

You may use the Site to learn about our cash-buying services, request a cash offer on your property, ask questions, and access educational content. When you use the Site, you agree to:

  • Provide accurate information about yourself and any property you ask us to consider
  • Use the Site only for lawful purposes
  • Not attempt to interfere with the Site's operation, security, or other users' access
  • Not scrape, copy, or republish content for commercial purposes without our written permission
  • Not impersonate any person or misrepresent your relationship to a property

We reserve the right to refuse service, terminate accounts, or remove content at our discretion if we believe these Terms have been violated.

4. Our website is not a binding purchase offer

A real estate transaction with Astra begins only when:

  1. You contact us and provide property details
  2. We send you a written, individualized cash offer specific to your property
  3. You and Astra sign a separate written purchase agreement outlining the price, closing date, and conditions

Until those three things have happened, neither party is committed to anything. Conversations, emails, text messages, and even verbal price discussions before a signed purchase agreement are informational and non-binding. You can walk away at any time before signing. So can we — though in practice we honor every written offer we send for the validity period stated in it (typically 7 days).

5. No broker or fiduciary relationship

Astra is a real estate investor purchasing properties for our own portfolio — to renovate, rent, or resell. We are not acting as your real estate broker, agent, attorney, fiduciary, or financial advisor.

This means a few things:

  • We are not legally obligated to put your interests above ours — we are a counterparty in a negotiation, like any buyer would be
  • We do not owe you the duties that a licensed real estate agent owes to a client under California Civil Code §2079.13–2079.24
  • If you'd benefit from agent representation, we encourage you to hire a licensed California real estate agent of your choice
  • You are always free to get a second opinion, list with an agent instead, or sell to another buyer
That said, we operate transparently and try to make sure every seller has enough information to make an informed decision. If a traditional listing would serve you better than a cash sale, we'll say so directly.

6. No legal, tax, or financial advice

The Site contains general information about topics like probate, capital gains taxes, foreclosure timelines, California real estate procedures, and home selling. This information is educational only — it is not legal, tax, financial, or professional advice.

For advice specific to your situation, please consult:

  • A California-licensed attorney for legal questions (probate, divorce, foreclosure, title issues, contract review)
  • A certified public accountant (CPA) for tax questions (capital gains, step-up basis, depreciation recapture, 1031 exchanges)
  • A licensed real estate agent for listing strategy, comparative market analysis, or representation
  • A financial advisor for decisions about how to invest or manage sale proceeds

Astra does not employ attorneys, CPAs, or licensed real estate agents in any advisory capacity. We can describe how our process works, but we cannot give professional advice on your specific situation.

7. Information you provide to us

When you contact us about a property, you confirm and agree that:

  • You have the legal right to provide the information you're sharing — meaning you own the property, you're a co-owner, you're an authorized agent, an executor, a trustee, or otherwise have authority to discuss the property's potential sale
  • The information you provide is accurate to the best of your knowledge
  • You authorize us to look up public records about the property (title, tax records, recorded liens, comparable sales) as part of preparing an offer
  • You understand that we may share necessary information with title companies, escrow officers, and professional service providers if the transaction proceeds

8. Your 5-day cancellation right

Every written purchase agreement Astra issues includes a 5-day cancellation period, beginning the day after you sign. During this window, you may cancel for any reason or no reason, with no penalty.

To cancel, simply notify us in writing (email is fine) within the 5-day window. We will void the agreement, return any earnest money to you, and end the transaction with no hard feelings and no legal action.

We provide this cancellation right voluntarily — California law only requires a similar right in specific situations such as equity purchases from homeowners in foreclosure (see Section 9). We extend it to every transaction because we want every seller to feel fully comfortable with the decision.

9. California equity purchase law (foreclosure situations)

If you are selling a property that is in foreclosure — meaning a Notice of Default has been recorded and the foreclosure has not yet been completed — California Civil Code §1695 (the "Home Equity Sales Contract Act") applies to our transaction. This law provides specific protections to homeowners in foreclosure, including:

  • A mandatory 5-day right to cancel the purchase contract
  • Specific contract language and disclosures required by statute
  • Restrictions on certain contract terms
  • Civil and criminal penalties for buyers who violate the statute

Astra fully complies with §1695 in every applicable transaction. Nothing in these Terms overrides, waives, or limits your rights under this statute. If our contracts or these Terms ever conflict with §1695, the statute controls.

10. Intellectual property

All content on the Site — including text, photographs, graphics, logos, design elements, and the Astra Home Buyer name and branding — is the property of Astra Home Buyer LLC or our licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

You may view, save, and print pages from the Site for your personal, non-commercial use. You may not reproduce, distribute, modify, or create derivative works from our content without our written permission.

11. Third-party links and services

The Site may contain links to third-party websites or reference third-party services (Google Maps, government records, attorneys we've recommended, etc.). These third parties have their own terms and privacy policies, and we are not responsible for their content, services, or practices.

Reference to or a link to a third party is not an endorsement unless we explicitly say so.

12. Disclaimers — Site provided "as is"

We work hard to keep the Site accurate, current, and functional. But we provide the Site "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.

Specifically:

  • We do not warrant that the Site will be uninterrupted, secure, or error-free
  • We do not warrant that market data, median prices, or examples shown are current at the moment you read them
  • We do not warrant that any cash offer estimate or pricing example will match what we'd actually offer for your specific property
  • We do not warrant that information about California probate, tax law, foreclosure procedures, or any other legal/financial topic is current — laws change, and we are not lawyers

Use of the Site is at your own risk. Always verify important information independently before making a decision based on it.

13. Limitation of liability

To the maximum extent permitted by California law, Astra Home Buyer LLC, its members, officers, employees, contractors, and affiliates will not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages of any kind
  • Lost profits, lost data, lost opportunities, or business interruption
  • Damages arising from your use of, or inability to use, the Site
  • Damages arising from any reliance you place on Site content before signing a written purchase agreement
  • Damages arising from third-party services linked from or referenced on the Site

Our total liability for any claim related to the Site (excluding claims related to an executed purchase agreement, which are governed by that agreement) is limited to one hundred U.S. dollars ($100.00) or the amount you have paid us, whichever is greater.

Some California consumer protection laws may not permit certain limitations of liability. Where those laws apply, this section is limited to the extent allowed but otherwise remains in effect.

14. Indemnification

You agree to defend, indemnify, and hold harmless Astra Home Buyer LLC and its members, officers, employees, and contractors from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your violation of these Terms
  • Information you provided to us that was inaccurate or unauthorized
  • Your violation of any law or third party's rights in connection with your use of the Site

We reserve the right to assume exclusive defense of any matter you've agreed to indemnify, in which case you agree to cooperate with us.

15. Dispute resolution

Step 1 — Talk to us first

If you have a complaint or dispute, please contact us first at [email protected] or (310) 999-3228. We take complaints seriously and most disputes can be resolved through direct conversation. We commit to responding to any complaint within 10 business days.

Step 2 — Mediation

If we cannot resolve a dispute through direct communication within 30 days, both parties agree to attempt resolution through non-binding mediation through a mutually agreed mediator in San Diego County, California. The parties will share mediator fees equally.

Step 3 — Court (no mandatory arbitration)

If mediation does not resolve the dispute, either party may pursue the matter in the appropriate state or federal court located in San Diego County, California. We do not require you to waive your right to a jury trial or to participate in class actions. This is a deliberate choice — California courts have raised concerns about mandatory arbitration in consumer real estate contexts, and we'd rather not test those limits.

Nothing in this section limits your right to file a complaint with a government agency (such as the California Department of Real Estate, the California Attorney General, or the Federal Trade Commission) or your right to pursue small claims court for qualifying disputes.

16. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any legal action arising from or related to these Terms or your use of the Site must be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to the jurisdiction of those courts.

17. Changes to these terms

We may update these Terms from time to time to reflect changes in our practices, the law, or our business. When we make changes, we will:

  • Update the "Last Updated" date at the top of these Terms
  • Post the revised Terms on this page
  • For material changes, provide reasonable notice through the Site (and where appropriate, by email if we have your address)

Your continued use of the Site after Terms have been updated constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, please stop using the Site.

Changes do not affect transactions already in progress — if you've already signed a written purchase agreement with us, that agreement's terms control regardless of later Site-Terms updates.

18. Severability, waiver, and entire agreement

If any provision of these Terms is found unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will continue in full force.

Our failure to enforce any provision of these Terms is not a waiver of our right to enforce that provision later. No oral statement by any Astra representative modifies these Terms.

These Terms, together with our Privacy Policy and SMS Terms, constitute the entire agreement between you and Astra regarding your use of the Site. Any written purchase agreement we later sign for a specific property will contain its own complete terms specific to that transaction.

19. How to contact us

For questions about these Terms, to report a concern, or to begin the dispute resolution process described in Section 15:
